These Terms & Conditions ("Terms") constitute a legally binding agreement between you and ChurchNest regarding your use of our services, website, and applications. By accessing or using ChurchNest, you confirm your acceptance of these Terms. If you do not agree to these Terms, you must immediately discontinue use of the platform. These Terms should be read alongside our Privacy Policy and any other policies referenced herein.
Grant of License
ChurchNest hereby grants you a non-exclusive, non-transferable, revocable license to access and use the platform for your personal, non-commercial use in accordance with these Terms. All rights not expressly granted herein are reserved by ChurchNest. You may not use the platform for any purpose other than those described in these Terms.
Permitted Use
You agree to use ChurchNest solely for: • Managing church member information and profiles • Organizing events, groups, and ministries • Processing donations and managing giving • Coordinating volunteers and scheduling • Facilitating prayer requests and pastoral care • Generating reports and analytics • Other legitimate church management purposes
Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and are liable for all activities that occur under your account. You agree to notify ChurchNest immediately of any unauthorized access or use of your account. You agree not to share your credentials with third parties.
You agree not to use ChurchNest in any way that: • Is unlawful, illegal, or unauthorized • Violates any applicable laws or regulations • Infringes on the rights of others (intellectual property, privacy, etc.) • Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age • Is defamatory, harassing, abusive, or threatening • Is likely to disrupt our service or infrastructure • Attempts to circumvent security measures or gain unauthorized access • Transmits malware, viruses, or harmful code • Involves reverse engineering or attempting to derive source code • Involves commercial use without prior written consent • Involves automated data collection without permission • Advocates, promotes, or assists any unlawful activity
All content, features, functionality, and materials on ChurchNest, including text, graphics, logos, images, code, and software, are the exclusive property of ChurchNest or its content suppliers and are protected by international copyright, trademark, and other intellectual property laws. You agree not to reproduce, modify, distribute, transmit, or create derivative works of any content without explicit written permission from ChurchNest. User-generated content remains your property, but you grant ChurchNest a license to use such content to provide and improve our services.
Your Responsibility
You are responsible for all content you upload, post, or transmit through ChurchNest, including member information, donation records, and communications. You represent and warrant that you have all necessary rights to the content you submit and that such content does not violate any third-party rights or applicable laws.
Our Rights
You grant ChurchNest a worldwide, royalty-free license to use, reproduce, modify, and distribute user-generated content for the purpose of providing and improving our services. We may not use member information for marketing purposes without explicit consent.
Content Removal
We reserve the right to remove any content that violates these Terms or applicable laws, without prior notice. Repeated violations may result in account termination.
ChurchNest provides the platform on an "as is" and "as available" basis without warranties or representations, express or implied. We do not warrant that: • The platform will be uninterrupted or error-free • The platform is fit for a particular purpose • Information provided is accurate, complete, or up-to-date • Defects will be corrected • The platform will be secure • Any third-party integrations will function properly To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for purpose, and non-infringement.
To the fullest extent permitted by law, ChurchNest shall not be liable for: • Direct, indirect, incidental, special, consequential, or punitive damages • Loss of profits, revenue, data, or business opportunities • Damage to your device or loss of data • Third-party claims arising from your use of the platform • Any disruption of service or loss of functionality In no event shall ChurchNest's total liability exceed the amount you paid for the service in the preceding 12 months, or £50, whichever is greater. This limitation applies regardless of the cause of action or theory of liability.
You agree to indemnify, defend, and hold harmless ChurchNest and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: • Your use of or conduct on the platform • Your violation of these Terms • Your violation of applicable laws • Your infringement of third-party rights • User-generated content you submit • Any dispute involving your account
Termination by You
You may terminate your account and these Terms at any time by contacting us. Upon termination, your right to use the platform ceases immediately, though you may retain a copy of your data in accordance with our Privacy Policy.
Termination by ChurchNest
We may terminate or suspend your account and access to the platform immediately, without notice or liability, if: • You breach these Terms • You violate applicable laws • We cease operating the service • We determine in our sole discretion that termination is necessary
Effect of Termination
Upon termination, all rights granted to you are immediately revoked, and you must cease use of the platform. Certain provisions survive termination, including limitations of liability, indemnification, and dispute resolution.
ChurchNest reserves the right to modify these Terms at any time. We will notify you of significant changes via email or prominent notice on our website. Your continued use of the platform following such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modifications, you must discontinue use of the platform.
ChurchNest may integrate with or link to third-party services, payment processors, and platforms. We are not responsible for the content, accuracy, or practices of third-party services. Use of third-party services is governed by their respective terms and privacy policies. ChurchNest is not liable for any damage or loss resulting from your use of third-party services or any failure of third-party integrations.
Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Jurisdiction
You and ChurchNest submit to the exclusive jurisdiction of the courts of India to resolve any dispute arising from these Terms or your use of the platform.
Severability
If any provision of these Terms is found to be invalid, unenforceable, or illegal, such provision will be modified to the minimum extent necessary to make it valid, or if that is not possible, severed from these Terms. The remaining provisions will continue in full force and effect.
